GENERAL
1.1. These terms and conditions apply to the legal relationship that arises upon the purchase of products between Tip-Toping OÜ (Merchant), owner of www.kannike.eu (Online Store); legal address Punane Str 56, Tallinn, 13619, Estonia; registry code 10029074; VAT identification number 101238577; [email protected], and the person, who made the purchase (Customer).
1.2. In addition to these terms and conditions, the legal relations arising from the purchase of products via the Online Store are regulated by the laws in force in the Republic of Estonia.
1.3. The Merchant may change the general terms and conditions of the Online Store and the prices of the products and the services. The changes will be communicated in the Online Store environment. The terms and conditions and prices valid at the time of the transaction apply to the transaction.
PRICE
2.1. The displayed prices include 20% VAT valid in the Republic of Estonia.
2.2. A handling fee for the delivery method selected during the ordering process is added to the price of the products. The delivery method is selected and the delivery fee is calculated in the shopping cart.
2.3. If there is a discount code, the discount of the product is calculated after entering the discount code in the shopping cart.
PLACING AN ORDER
3.1. An order can be started by selecting flowers or a bouquet. You can add the selected flowers to the basket by clicking the “Buy” button.
3.2. If you want to send greetings, congratulations or other wishes alongside the flowers, select an appropriate card; clicking on it will open a web page with the card and a text box where you can enter the desired text. The Kannike flower shop does not include information about the Sender to the shipment – i.e. the card text is the only information that will reach the Recipient.
3.3. Once you have added everything you like into your shopping cart (by clicking on the corresponding button), the placement of the order will continue on the shopping cart page, which you will reach by clicking on the “Checkout” button.
3.4. The contents of the order you have compiled are displayed on the checkout page. The order line displays the product name, the price, the quantity and the total amount of the order line. You can change the quantity of the desired goods in the corresponding product line in the “Quantity” box.
3.5. On the order payment page, all fields marked with an asterisk must be filled in and the appropriate delivery and payment methods must be selected.
3.6. You can find the Merchant’s terms of transport on the “Delivery” page.
3.7. The products offered by the Merchant involve creative work, thus the Merchant cannot guarantee the appearance of the ordered product to be exactly the same as shown in the picture. Pictures of the products offered by the Merchant are for illustration purpose only.
3.8. The Merchant has the right to use flowers of other colours when filling the order, if there are no flowers of the ordered colour. The Merchant has an obligation to ensure that changing the colour of the flowers does not reduce the monetary value of the order.
PAYMENT
4.1. In the bank’s online environment, you can pay for the order via a bank link or using a credit card. After payment, be sure to press the “Back to Merchant” button! If you return to the Kannike online store after pressing the button, the order has been successfully submitted.
4.2. After you have made the purchase and paid for the order, we will send you an e-mail acknowledging the receipt of the order. If you do not receive the notification by e-mail, call +372 55501750 for more information.
4.3. If the Internet browser crashes or other complications occur after pressing the button, please contact Kannike at +372 55501750 or [email protected] to specify whether the order has reached the Merchant. After paying in the bank, the administrator of the Kannike online store will receive the relevant information and your order will be processed.
ORDER FULFILMENT
5.1. We shall remind you that on the more popular festive days (Valentine’s Day, Women’s Day and Mother’s Day), express orders and courier orders with pre-defined delivery times shall not be fulfilled; all orders are fulfilled during the day as they are received.
5.2. Flowers are a seasonal product and not all flowers / colours may always be available in all the stores, which is why Kannike reserves the right to replace materials if necessary, within the limits of the paid amount. In case bigger replacements are needed, we shall contact the Sender by phone or e-mail to agree on the replacement.
5.3. The Recipient is ALWAYS contacted in advance by phone to agree upon a suitable for all the parties time and place for the delivery.
5.4. If we are unable to contact the Recipient, we will contact the Sender by e-mail or phone.
5.5. The shipment is handed over by the courier service provider, not by the florist.
5.8. If you wish to cancel the order, please do so 1 (one) working day before the date of order fulfilment or by separate agreement with our customer service ([email protected] or by phone +372 55501750).
CANCELLING AN ORDER
6.1. In the absence of the goods ordered by the Customer and in case of unsuitability of the replacement goods, the Merchant shall cancel the order. The order can be cancelled in part or in full. The Customer will be notified immediately of the cancelled order. In case of partial cancellation, the Merchant may inquire about the Customer’s wishes for handling the rest of the order – either to send it or to cancel it too.
6.2. Upon cancellation of the order, the amount paid will be refunded to the Customer as soon as possible, but not later than within 14 days from the confirmation of the cancellation of the order.
6.3. In order to exercise the 14-day right of return, the ordered goods may not be used in any other way than is necessary to verify the nature, characteristics and functioning of the goods in the manner permitted for testing the goods in a physical store. If the goods have been used for purposes other than those necessary to verify the nature, characteristics and functioning of the goods or there are signs of use or wear, the Merchant has the right to reduce the refundable fee according to the decrease in the value of the goods. The Buyer must return the goods within 14 days of submitting the corresponding application, or provide proof that he or she has handed over the goods to the carrier of the goods within the aforementioned period. Upon receipt of the returned goods, the Merchant shall return to the Buyer without delay, but not later than 14 days after receipt of the withdrawal application, all fees received from the Buyer on the basis of the contract. The Merchant may refuse to make refunds until it has received the item which is the subject of the contract or until the Buyer has provided proof that he or she has returned the item, whichever takes place earlier. If the Buyer has explicitly chosen a delivery method different from the cheapest usual delivery method offered by the Merchant, the Merchant does not have to return to the Customer the cost that exceeds the cost related to the usual delivery method. The Merchant has the right to withdraw from the sales transaction and reclaim the goods from the Customer if the price of the goods in the online store is marked significantly below the market price of the goods due to an error.
6.4. If necessary, the Merchant has the right to cancel the order, by returning the full paid amount to the Buyer.
PRODUCT RETURNS
7.1. After receiving the order, the Buyer has the right to withdraw from the contract concluded in the e-shop within 14 days. Returnable products include drinks, sweets and cards. Flowers are perishable goods and cannot be returned.
7.2. In order to return the goods, an application for withdrawal from the purchase of the goods must be submitted, the form of which can be found here: withdrawal application and sent to the e-mail address [email protected] no later than within 14 days of the receipt of the goods.
7.3. The costs of returning the goods shall be borne by the Buyer, unless the reason for the return is the fact that the item to be returned does not correspond to what was ordered (e.g. a wrong or defective item).
7.4. The right of withdrawal does not apply if the buyer is a legal person.
RIGHT TO MAKE A CLAIM
8.1. The Online Store is liable for the non-compliance with the contract terms or defect of the goods sold to the Buyer, that already existed at the time of the delivery of the item and that became apparent within two years from the delivery of the goods to the Buyer; during the first six months after the delivery of the item to the Buyer, it is presumed that the defect already existed at the time of delivery of the item. It is the responsibility of the Online Store to rebut the respective presumption.
8.2. Upon discovering a deficiency, the Buyer has the right to contact the Online Store within two months at the latest, by sending an e-mail to [email protected] or by calling +372 55501750.
8.3. The Online Store is not liable for defects that have occurred after the delivery of the goods to the Buyer. If the goods purchased from the Online Store have defects for which the Online Store is responsible, the Online Store will repair or replace the defective goods. If the goods cannot be repaired or replaced, the Online Store will return all the fees associated with the sales contract to the Buyer.
8.4. The Online Store shall respond to the complaint submitted by the Consumer in writing or in a form that can be reproduced in writing within 15 days.
